• Carrier has the ability to protect the words HYBRID HEAT^® to the extent they are being used as an identifier of the source of the product (which is what a distinctive mark does) but no ability to protect against use of the words in a descriptive sense. Thus, if a competitor advertises its "HYBRID HEAT^® dual fuel system" (notice the ALL caps treatment) Carrier can object, but if it advertises its "hybrid heat system" there is nothing Carrier can do because the words are merely being used in the ordinary descriptive sense.

• As much as it is practicable to do so, avoid saying "Carrier HYBRID HEAT^®" but say "HYBRID HEAT^® dual fuel systems by Carrier". Linking the Carrier and HYBRID HEAT^® marks together is bad practice.
